I'd like to know what the basis of the suit is. All vehicles of a given class are very similar these days. Unless the Chinese company is violating copyrights or patents by using cloned Mercedes logos or by copying proprietary technology, I don't see a successful suit on the horizon. A better approach for Mercedes is to simply licence the Smart to the Chinese and get out of it and sit back and collect royalties. Mercedes should concentrate on improving the B-class instead. The B should be taller as there is not enough room between the top of the front seat and the roof to allow me to get in without banging my head on the roof. My wife complains that the hood slopes in a way that prevents her from judging where the front of the car is. In Canada, Mercedes has packaged the power seats option with a glass roof that I would hate to have in a rollover.
