Lotus could return to Formula One from 2010
It was recently revealed by F3 racing team Litespeed that it could revive the famous name of Team Lotus if the FIA will permit it to continue to the top category the following year. This followed the talks between David Hunt, Lotus name’s rights holder, and the top execs of Litespeed namely Nino Judge and Steve Kenchington, both of whom worked for Lotus when it last raced in F1.

Johnny Herbert, former F1 winner and Lotus driver, will also be part of the project as driver manager and team ambassador together with Mike Gascoigne, former designer for Toyota and Renault and BBC analyst. This Friday the F1 governing body, FIA, will see if Team Lotus and the 13 other 2010 F1 applicants succeed. During its total of 36 years in Formula 1, Team Lotus has garnered six drivers’ titles, seven constructors’ trophies, 73 races won, 102 positions and 65 fastest lap awards.

it's the rights to use the name that are being discussed here. The team itself is not the same as Lotus the car manufacturer, although negotations will no doubt tie the two togther if it all works out.
