Toyota Urges Judge To Throw Out Sudden Acceleration Lawsuits As Baseless
Toyota Motor Corp. urged a U.S. judge to dismiss lawsuits over sudden acceleration claims saying they’re based on anecdotes and fail to identify any specific defects in the vehicles.

Toyota, the world’s largest automaker, faces more than 300 federal and state lawsuits including proposed class actions over economic losses and claims of personal injuries or deaths related to allegations the vehicles suddenly accelerated and couldn’t be stopped.

“Plaintiffs infer negligence and strict liability on the part of Toyota based on unsubstantiated circumstantial information,” the automaker said in papers filed in federal court in Santa Ana, California, Sept. 13.

Baseless because their own blackboxes are flawed and weren't able to record the proper speeds of the vehicle (let alone anything else they may still be covering up). Or baseless because there are some money grabbers mixed in with legitimate cases?

Driver error? Why dose it only happen to Toyota cars and not a mixture of brands?

Disagree.

IMHO Toyota continues to cover up the truth that there is a problem in the ECU by saying that the plaintiff's should bear the burden of proof.

Ok, fair enough. Then Toyota should be willing to release the ECU software code (source + libraries, not executable) so the plaintiff's and the software community can do an appropriate independent engineering analysis.

This is the only way to get to the truth. Until then, its he said, she said, he denies, she counter-claims.

Only corporations are treated with such kid gloves.

If you or I were seriously suspected of having killed someone, we'd be arrested, hauled into court, and the weapon would be confiscated and subsequently tested by an independent crime lab to determine if it was the killing weapon and who was the likely killer.

Don't understand why the same procedure doesn't apply to multi-billion dollar corporations. Oh wait, I know... $$$$$$$$$$$$$$$$$$$$$$$$$$$$

Besides the obvious case in California of the police officer killed in the Lexus.....who has been killed?

Spot on thstone - individual citizens are treated differently from corporations. And this is true in any and all country, including the US. I'm beginning to wonder why citizens even bother to vote, why don't we just let the companies fight one another on which officials get into office.
