Federal Judge BLOCKS Removal Of Red Light Cameras After Voters Oust Them
A federal judge issued an order last Friday blocking the immediate removal of red light cameras from Houston, Texas intersections. On November 2, voters adopted an amendment to the city charter making photo tickets unenforceable, against the wishes of the Houston city council and the private vendor that operates the cameras, American Traffic Solutions (ATS). Over the Thanksgiving holiday, US District Court for the Southern District of Texas Judge Lynn N. Hughes worked out a deal with the city and ATS to preserve the cameras, for now.

"The city of Houston and American Traffic Solutions, Inc, will continue to collect the fines for the traffic violations that occurred through November 15, 2010," Hughes wrote in his order. "The cameras will not be removed during the pendency of the litigation."

I would guess about around WWII and we slowly lost democracy after that.

you cant say Democracy ended based on what one Judge decides, this can be appealed and the Judges Judgment is called to question.

The problem is in the details of the contract.

For instance in my city they never enter a contract without providing a way out. So when our voters kicked red light cameras to the curb. They exercised that provision and the cameras were turned off at the first of the month.

In this case the city counsel approved a binding contract with no way out early. Now they are all in a heap of trouble. To keep the cameras after the vote is a political death warrant. To remove them ends in an ultra expensive lawsuit, another possible political death warrant.

Either way they made a deal with the devil and can get out.

They deserve to suffer the ramifications of a poorly written contract.

The title is a bit misleading. The article clearly states that the fines will stop as of November 15th and that the cameras will simply remain installed during the litigation.

This is an AMAZING case! It shows exactly why red light cameras exist... for money. Firms like ATS push the idea onto city councils, promising that the city will earn revenue and then when citizens and voters say that they dont like what their city council did, ATS gets the legal team ready for war to keep their money flowing! This has NOTHING to do with safety. "Safety" is obviously just the marketing ploy to convince voters that they are needed.

Yea in a right wing Republican town like Houston what do you expect. All law and order...Big Daddy is going to take care of you whether you want it or not. We will listen to your phone, we will watch you on the street and even your bedroom. Now that is where they really need these red light cameras :).

Interestingly " All City Council Posts, the City Controller, and the Mayor all had elections. All positions are non-partisan." However point taken as the new mayor was helped by some democratic operatives it seems. My point though is that red light cameras are hardly a democratic or republican issue. Both are bad at wanting to control our lives - Republicans through a police state and Democrats through our wallets. Red light cameras happen to serve both equally well unfortunately.
