Insurance Companies Sue Toyota For Negligent Design
Seven insurance companies have sued Toyota Motor Corp. in an attempt to recover money paid to cover crashes they blame on sudden acceleration.

The insurers cite data that blames 725 crashes on the problem and fault the Japanese automaker for failing to equip its cars with an override system that would cause a car to idle if the brake and gas were deployed simultaneously. They are seeking damages in excess of $230,000 from 14 crashes throughout the United States.

This case has a shot! The legal teams will probably use the interaction between the floor mats and the accelerator pedal.

Even if Toyota did not design the floor mats themselves, the supplier would have wanted gotten an indemnity clause against these types of issues from Toyota. It was also Toyota that placed the mats, or sold the mats as an option, in their cars. Outside of proving a defect with Toyota's ecu, accelerator, etc., the insurance companies may have enough evidence to justify this case going to trial.

Either way, lets be real here, if a judge clears these case(s) to go to trial:
- Toyota will cut a huge check(s) with a condition of not admitting guilt
- Court records will be sealed
- "News" outlets will give this a five second mention at best
- Public forgets and moves on

It's the insurance companies own fault. They should have done their research before insuring cars the same way they come up with how much to charge for a particular vehicle. Auto insurance is just a racket and should be far less than what we pay.

Does anyone remember us doing this dance the first time around, when we did it with Audi's unintended acceleration fiasco? CSI's could trace a fault to a Toyota defect. Neither did NASA. Neither has the US Government Enquiry into this issue. But insurance companies believe they know "the truth."

A jaded Steve speculates that perhaps some greedy insurance companies have made some unanticipated payouts on insurance claims, and this is negatively affecting their bonuses, so they want to get some of that money back. What's next? Raising premiums for all Toyota vehicles because the insurance companies *believe* there is a defect?
