Owners Sue Automaker After Fumes From Cars Left Running In Garages Cause Deaths
Car keys are becoming obsolete as more and more carmakers offer keyless ignition fobs, but the item that's supposed to make life easier for drivers is now accused of taking life in three separate incidents, and causing accidents and headaches for drivers across the country.

Three deaths -- one in New York, and two in Florida -- are raising the spotlight on keyless ignition, after drivers who left engines running in attached garages died of carbon monoxide poisoning in their sleep.

Mary Rivera of New York survived the carbon monoxide poisoning that killed her longtime partner, Ernie Codelia.

Maybe the first clue to shut the engine off would be the noise the car is generating from the engine RUNNING?

Come on people this is a lack of individuals accepting responsibility for their actions. It is the driver's responsibility to make sure the vehicle is parked in a safe manner and that includes turning off the motor.

Most people are cognizant of their actions and possible consequences. Then there are those that are less aware and easily distracted, which can cause situations like this to occur. The bigger picture however, is that in this day and age we are accustomed to a perceived exemption of personal liability. As long as our court systems continue to allow frivoulous suits with huge payouts, you cannot expect that society will ever embrace personal responsibility the way our earlier generation did. My take on this whole situation would be for car manufacturers to install CO2 sensors in the car which can shut the car off if the levels get too high. This in turn would protect everyone.

anyone "easily distracted" enough to leave a car running that they could turn off just by pressing a "STOP" button would be just as likely to be distracted enough to leave a car running with a traditional twist key. And anyone who wins a lawsuit like this is making a mockery of the legal system. It's the car equivalent of the lady who spilled hot McDonalds coffee on herself.

The OEM is not at fault here! If you are dumb enough to leave your car running then well, you caused your own death!

I'm sure the OEM's liability ends with telling you in the manual how to start and turn off the engine. Which you by the way have done many times before.

I guess a grey area that the blood sucking trial lawyers will circle is if the dealer didn't explain to you how to start and stop the engine, if this happened the day you got the car or if this was your first keyless starting automobile...

Its just a shame that we even have to discuss this!

I saw an episode of Holmes on Homes the other night. The peoples garage was attached to the house. Not like, oh here is a wall separating. But they had no wall!. It was a straight shot up the stairs from the garage with no door, and the HVAC ducts went from the garage upstairs!

I'm sorry for the family of these people. It's a terrible accident. Almost all cars are coming with smart key's. If you buy a car with that feature you are responsible to learn how to use it.........

it is a matter of fact that there has been exponential growth in the frivolous lawsuits arena, the list of lawsuits that would be laughed out of court in other countries yet is given full judicial consideration in the USA is beyond parody, Hell we foreigners even believe some of these awards are a result of serious bribes because the alternative is that there are some seriously stupid judges on the USA bench.

But the fact that most of the comments on this article agree with me gives me hope, maybe we are as a species not doomed.

NO attorney or plaintiff has ever awarded punitive o other damages to himself. That is the job of a judge in some cases (bench trial) or mostly a JURY (jury trial), made up of PEOPLE, just like us!! It is a VERY important part of the DEMOCRACY in which we live. Respect it or give it up! Don't be so cynical about a system that is YOURS!! Courts have remedies for plaintiffs and LAWYERS who run afoul of the system...they get fined, dis-barred or sent to jail, or in the case of plaintiffs, they pay the other sides’ attorneys fees for wasting everyone’s time with so called frivolous lawsuits!

We can SPECULATE and JUDGE all we want but remember we are not the tryers of fact. We don't know what happened. The courts are there to sort that out. Have SOME faith in your country and YOUR system. Let foreigners be damned, if they don't want to understand that!!!

I swear I think they use law suites as compensation for stupidity. People so stupid $hit all the time, law suites can't fix stupid. Theres always some stupid law or rule to accommodate the stupid people of the world. Why do you think when you buy a piece of stereo equipment it has that package of drying agent that says do not eat. Anyone here think that when they bought a DVD player it just might have something to eat in there. What is funny is I wonder how many of these dumba$$es have actually seen on the news or in movies were people commit suicide by leaving the car running in the garage? People are becoming more stupid everyday because the world makes special rules and accommodations for their ignorance rather than making them learn
