WTF? Traffic Camera Vendor Sues City For No Longer

Traffic camera vendor American Traffic Solutions showed no municipal love as it filed a breach of contract suit against Baytown, Texas on Monday. The St. Valentine’s Day complaint accused the city of failing to approve the mailing of an expected number of red light camera citations generated by the company.

 

According to court filings, ATS generated 2420 tickets in November 2010, and the city accepted all but 425 — an 82 percent approval rate. The next month, ATS generated 2837 tickets, but the city only approved 587 — a 21 percent rate. By January, the city had only approved two tickets. ATS insists that failure to allow the mailing of tickets constitutes material breach of a contract binding through the year 2019. For its part, the city is unable to approve any tickets because voters approved a referendum in November prohibiting the use of red light cameras unless a police officer is present to witness any alleged offense. ATS has refused to acknowledge this public vote.

Label me a liberal MILF if you'd like but I am all about MY rights. When my funds are short, I don't get to go out and set traps for my neighbors to increase my revenue, I have to cut my spending. I would have no problem with traffic cameras if they weren't tied to my insurance rates, and if I still retained my right to fight them in court. Remember that "due process" thing the founding fathers made up?

In Houston, they never took the issue to the voters and never reviewed the contract they entered into with ATS.

The voters rejected to the cameras, and the city was on the hook for a contract they could not get out of. IMHO, that should have cost them their jobs, they should have known better.

Pure and simple. ATS has no case. Period. Oh they will argue (their company depends on them arguing)and will fight to rob you of your hard earned money, but they will lose.

Any time a business does work for a local, state or federal government there is a clause put into the contract that basically states they are subject to the will of the people. If the government decides to change the law allowing the company to operate in their district, the company is forced to comply to meet the new requirment or cease and desist.

Thats about it in a nutshell.

Yes to cameras on every corner to catch these terrible law breakers! We should also require cameras in every public place and everyone to have an rfid chip implanted so we know who we are dealing with. We also need cameras in every home in every room. If you have nothing to hide and you are not breaking the law you will not get in trouble. However if you are doing something illegal (check your state for sexual laws) we can now catch you and add revenue to our local governments. I am not sure how long it will take but they also need GPS chips in every car that ties directly back into law enforcement, which when combined with the rfid chip can ensure every instance of speeding and other infractions are caught and the right person fined. We need these types of programs that raise lots of revenue to fund more of these types of controls and many additional prisons to ensure we live safe lives free from criminals and other scary stuff. We must look to our government and hope that we have a strong authoritarian in power to ensure all this comes to pass soon.
