Toyota wins 'unintended acceleration' case in New York
Toyota won an "unintended acceleration" case in New York against an emergency-room doctor who claimed that his 2005 Scion tC "suddenly and without warning accelerated", not stopping until it hit a tree. Toyota countered that Dr. Amir Sitafalwalla stepped on the accelerator instead of the brake.

When your own witness backs down, it's time to pack it in. Let's see who else has a "real" case worth pursuing. BTW, for all the naysayers, give the legal system a chance; it still works!

Toyota should sue Dr. Amir Sitafalwalla for the damage, then this guy probably has to file for bankrupt.

The thing we need to keep in mind is that nobody -- not the NTSA or CSIs or a Federal Government Inquisition or even NASA -- could prove that the unintended acceleration incidents were actually caused by a defect in a Toyota vehicle. It appears, just like in the Audi unintended acceleration debacle, that the run-away cars happened because of "pedal misapplication."
