I'm definitely selling back my 2009 Jetta, as it has a CEL and non-functioning A/C. My 2014 Passat, I'm torn. However, it's probably going back as well. I'm leaning towards a Subaru Forester with the EyeSight technology. The advanced cruise control works really nice. Since my VW dealer also sells Subaru, I can keep my terrific relationship with the dealership. Yes, I like them that much. I have two dealerships closer to me but I still drive to Bellevue for them.

Clarification: VW has filed a settlement proposal with the courts. The courts will now either accept or decline the settlement. It's not a done deal yet.

Also, this applies only to the 2.0 Liter (and smaller) diesels sold in the US. It does not apply to the 3.0L V6s, which appeared in some VWs, Audis, and Porsches.

FWIW, I have an affected Audi Q5 3.0L diesel, and I hope some cash comes my way. I love my car, but a cash bonus is nice, just the same :-)

Also to add, according to VW's website at https://www.vwcourtsettlement.com/en/ "...Modification must be approved by EPA and CARB..."

So to summarize what we have at this time:
(1) VW has submitted an emissions fix PROPOSAL to the EPA and CARB
(2) EPA and CARB have not approved it yet (no word if they will)
(3) VW has submitted a class action lawsuit settlement PROPOSAL to the courts
(4) The courts have not approved it yet (no word if they will)

This news still looks like a bunch of maybes and hopefulness, but nothing definite yet.

It will be interesting to see how many take the buy back and go elsewhere.

I'd love to see a car company do an ad "Now that you have your buy back money from VW, come buy a Chrysler 200 and we'll give you a $2000 incentive..."

I am waiting to see if any of the occurs. And as Steve said, we still have to wait for the judge to sign off on it. As an owner I'm satisifed with the proposal, with one caveat. They appear to be using trade-in value for the buyback, not retail value. I read two different VW press releases, and one says retail and one says clean trade-in. The amounts listed in the tables seem to match trade-in, not retail value. I think it should be retail.

I've said it should be retail value and have been excoriated.

The simple reason VW should pay the customer their original down payment and reimburse all payments made is because the cars were not legal to own.

Nimrods say "Well they got the use of the car, so you can't fully reimburse them." That kind of thinking lets VW off the hook.

A better solution would be to offer the owners a modern equivalent TDI--which will be legal to sell once VW and the Feds come to an agreement--or the price of a modern equivalent as a buy back.

VW's proposal is low-balling the issue for obvious reasons. VW needed to take the high road and do something magnanimous rather than continue being the petulant child trying to minimize his punishment through subterfuge.

The current deal includes using trade in values of the cars - JUST BEFORE - the news hit the fan. When you add $5000 to that - you come up with a price well above the "retail" value of the cars at that time. (Noting that these are all 2.0 liter Diesels).

Matt, I'm not implying they should refund MSRP, just retail value on the date last September this all hit the fan. As it is, I will get almost exactly what I paid for the Passat two years ago. As an owner, that seems fair. As you said, I've driven the Passat for two years and the Jetta for almost 5.
