Obama Administration Bypasses Congress On VW Settlement To Establish $1.2 Billion Slush Fund For Pet Projects
An almost $15 billion settlement was partially approved a few weeks ago by a federal court over Volkswagen AG’s emissions-cheating scandal, which involved the company installing defeat devices in more than 500,000 vehicles.
 
But the terms extend beyond the scope of Volkswagen and the federal agencies involved in the case, and appear to be unconstitutional.
 
The Obama administration has essentially found a workaround for extracting $1.2 billion from the automaker to go toward a zero-emissions vehicle technology slush fund (officially called the National ZEV Investment Plan), to be managed by the EPA. Congress has repeatedly voted to reject the fund.

Yet another load of biased, ideological hogwash. I notice the courses for these articles are all Libertarian outlets living in their own made-up dreamland of outright lies and exaggerations. Obama's actions are entirely Constitutional and covered under the terms of the EPA's founding. The EPA was formed by President Nixon and approved by Congress with powers to regulate, fine, and establish Voluntary Programs and settlements with industry and companies in order to develop infrastructure and technology. The State of California is actually the developer of this VW settlement and numerous states around the country abide by CARB regulations. Previous Congress bills were defeated because of budgetary concerns (ideology notwithstanding), but this program is not coming out of the Congressional Budget. It is entirely a VW fine negotiated under terms set within the bounds of the EPA and Congress. Congress of course has the final authority to decline this EPA action but they won't- it is too good of an idea and will help build out infrastructure nationwide providing hundreds if not thousands of jobs. it also is a good idea for the environment. If these Libertarian know-nothings would pull their head out once in awhile they might realize their self-defined "Constitutional" made-up Utopia never existed and never will.

Obama has established the presidency and the executive order as the most powerful legislative action in the land.

However since the executive order is essentially a short cut around the true process it is easily overturned by the administration that follows. In a nut shell he got his way for a short while only to have it thrown out in the next 100 days.

I guess there is no substitute for taking the time to do it right vs doing it for short term gain.

Please educate yourself and read up on the EPA's and the Wiki website what they can and cannot do. They clearly are within the scope of collecting fines and distributing them in programs to develop technology advancement. Congress gave them this authorization back in the early 1970's. On the other hand, Congress right now is within its bounds to revisit EPA decisions and decline them. Right now 2 Reps from Michigan are trying to lobby Congress to deny the spending (blocking VW for Ford and GM). Except this Republican Congress won't deny it. Because they know it is good business. You can can cry, stamp you feet, and pretend to know about the Constitution when it is quite evident you know nothing. IF you don't like the fact that the EPA can do this VW deal, don't cry about it to me. Cry about it to President Nixon and Congress who gave them the power to do it.
