Who Is Responsible? Lawsuit Against Apple Claims It Should Have Prevented Drivers From Illegally Texting

Apple has technology to prevent drivers from texting on their iPhones but failed to deploy it, leading to an epidemic of distracted driving and "carnage" on the roads.

That's the allegation of Julio Ceja, a California man who says he was rear-ended by a texting driver, and who wants a judge to halt all iPhone sales in the state until Apple enables a "lockout" feature to stop motorists using their phones.

Ceja's lawsuit, filed in Los Angeles state court, claims Apple's (aapl, -0.35%) failure to activate the lockout feature is a violation of California's consumer protection laws, and seeks to include other accident victims as part of a class action.

Will this guy also open another lawsuit claiming that the car manufacturer should've retrofitted the emergency braking systems onto the car which could've avoided the collision or at least reduced the damage? Maybe I should've give people ideas.
If Apple does install the technology, I'm sure people will find a way to work around it. Jailbreak their phones or someone will create an app to disengage it.

Thankfully - the person bringing the suit has no case. Texting while driving is illegal all by itself - Apple does not need to "prevent" it - the laws already do. For Example - the ability to govern a cars speed to prevent speeding has long been available - but it is NOT needed. Speeding is illegal - and it is the operators responsibility to maintain a legal speed.

I applaud this lawsuit, how many more people need to die because of these distracted drivers texting, facetiming, or phoning.

Laws are clearly not enough to stop these ppl from giving into their cell phones so yea it's time to talk to Apple about the technology. Distracted drivers are now the #1 cause of fatal accidents in the U.S. and the trend is not going anywhere. The #1 thing distracting them, their smart phone, the smart phone most involved and with the most market share in the US, Apple iPhone.

These idiots aren't responsible and less face it sometimes it's good well meaning people who get distracted for 2 seconds on their phone and sometimes that's all it takes. The laws aren't working the next step is technology.

Apple is sitting on a pile of cash and perhaps it could use some of the money saved to produce the phones in china to actually save some lives.

And sure ppl will find a way around it but I garuntee you the majority of ppl distracted won't care that much, and it doesn't hurt to try.

I'm hoping you are being sarcastic, but in case you're serious. No, look at the comments above. The law about texting already exists. It is not the responsibility of the phone (or car) manufacturer to add something on top of it.

The simple fact is that if we can use technology to prevent drivers from all hand-held phone use, then we need to mandate that technology by law. Just because a company has a technology that they have not deployed does not make them liable for anything so long as they are observing the law.

We already have the capacity to know if a driver was texting while driving and I would ADORE the death sentence for anyone who was texting and caused a death.

WE Already have the technology to embed the roads with Speed limit Electronics that could be picked up by cars - so that a car would be prevented from speeding - and if we follow your logic - then it is the responsibility of government who ha not done this for speeding drivers - and ALL cars should be required to have this equipment immediately. They also have technology used in adaptive cruise control - that could be used to set a REQUIRED distance between vehicles as well. Technology exists that would prevent a drunk person from starting a car from behind the wheel. I would assume we could use similar technology to enforce Licensing laws too. All of these things could save some lives too - and the question we really have to ask is - at what point do we want to allow or stop the intrusion of Big Brother into our Driving.

SO - Matt - do you want to reduce driving to an automatically controlled and Limited experience - because technology exists that would REQUIRE you to do so.? I would bet your answer would be no. May as well require all car to be driven autonomously by the state - and have NO driving at all.
