Who Is At Fault When Your Self Driving Car Crashes?

Tesla regularly implores drivers that use the company’s semi-autonomous Autopilot system to pay attention to the road and keep their hands on the steering wheel at al times. But a new report on a fatal March crash involving a Tesla Model X says the driver only had his hands on the wheel for 34 of the final 60 seconds before the collision, and, in that time, he received no visual or audio warnings to put his hands back on the wheel.

It illustrates the disconnect in Tesla’s deployment of Autopilot: Drivers are told to pay attention, while simultaneously encouraged to be inattentive, without any sort of prompt appearing for a lengthy period of time.

Sorry - San Jose Driver - but while those are what TESLA says - what will determine who is at fault will be the LAWS regarding who is in charge of the vehicle operation at the time of the crash. TODAY - no state allows full autonomy - all that allow it still require a DRIVER to be available to take over in cases of problems unanticipated by the software - among other things.So - in fact - the laws make the DRIVER at fault

The courts will have to determine other possibilities down the road - however - do you really think that ANY major manufacturer of cars is going to leave themselves open for THousands of suits without some type of Dislcaimer.

Courts WILL assign shared liability. Yes, manufacturer has the responsibility for the software/product, but the driver still has the responsibility for operating the car.

I don't believe that reliable and safe self-driving cars are reality today, so I would not find myself in such predicaments.

Isn't it cool that how a person thinks plays a huge role in how they experience life? Well... it's cool for some. For others, it's a curse, and they're likely to blame anyone, or anything, rather than be accountable for their thoughts, decisions, and actions.

Sorry - Carloslassiter - But what is clear is that YOU have not read any of my prior posts on this subject - I have clearly said that currently no state allows total autonomous operation - they all require a DRIVER to be able to take over in case of emergency or when the software fails - which actually leaves the responsibility to the "DRIVER".

This is not the same issue as the GUN issue.

People like you like to say - Guns don't kill people- people kill people - BUT there is ONE more sentence that is missing - PEOPLE WITH GUNS Kill people. DID you know that there are almost NO gun murders among people who do not have guns! (Tongue in cheek)

I have had guns from childhood - but I still maintain that no private person needs the firepower of these assault weapons - I am still waiting for a person to come up with a reason why a private person would need it. And - SInce I have had guns - I also know that not everyone knows how to properly fire one - and I also know that there are nuts out there who should not be allowed to actually buy one.

I believe that there should be a license procedure where you must show ability to control a weapon like a gun - and I believe ALL guns should be numbered and registered. AND I believe that anyone who uses a gun in a crime should face mandatory Death sentence by Firing squad.

Well, simply to say, I think it's definitely the automakers' fault. I have just read an article at https://www.lemberglaw.com/self-driving-autonomous-car-accident-injury-lawyers-attorneys/ about this matter. Hope it will help anyone who are currently searching for information about driver-less cars, especially the legal side of them.
