Volkswagen CEO Herbert Diess was given a memorandum warning the company might face legal action in the U.S. over the use of cheating software in cars just days before the scandal broke, a public broadcaster reported.

A former Volkswagen employee told the public prosecutor's office in Brunswick in VW's German home state that he wrote a so-called "one-pager" on Sept. 13, 2015, saying that Volkswagen had lost all credibility with U.S. authorities and was about to be charged, German public broadcaster NDR reported.

The employee further testified that he gave the document to Diess in person on Sept. 14, 2015, NDR said. U.S. regulators disclosed VW's violations on Sept. 18, 2015...

The question and issue is when did he first know or participated in VW cheating. Finding out two days before charges that VW lost credibility is not by a long shot the first time a high level VW executive learned about cheating for sure. At that point the company was well into CYA mode.

Piech is not the real villain Martin Winterkorn is. If you recall, Piech publicly stated he was distancing himself from the monster Winterkorn, and all hell broke loose in the Piech/Porsche family, because the Porsche family supported the wrong man and Piech got pushed out... the Porsche family and Winterkorn all know more than they said the do and still are hiding reams of information, like a dirty goverment... the company has dirty hands, the Porsche family has dirty hands. Many of the top people all knew and looked at getting caught as a "cost of doing business" and not as a surprise, the surprise came when it cost $30b to fix Winterkors arrogant, shortsighted, decisions... BUT, all of them thought Cheating would pay dividends and not be a complete fiasco. VW board, has screwed the public, VW owners, VW dealers worldwide and forever changed how the car business is conducted. All of them expected to LIE and get away with a minor fine and move on... Piech was the one voice of decent and got pushed out for calling it like he saw it.. in other words telling the truth.
